I've just been talking to a landowner who is having problems with roe deer, but he is convinced he cannot give me permission to shoot them as " they belong to the neighbouring estate, who rear and shoot them to sell as venison" I said that all deer are wild by law and that if they come onto your land you are free to shoot them, and I know I have read this somewhere. Was it on the BASC website or where , can anyone remember so that I can print it off as proof for him. Thanks in advance. Pete.

that only relates to wild deer.deer which reared/farmed,so therefore have 'escaped' I'm sure are covered by different legislation and are classed as 'owned'

There is no clear definition of farmed deer, but deer which carry tags which include the agricultural holding number, or which are listed as part of a farm enterprise, are
regarded as domestic livestock and therefore as property.

See if they are tagged first and if they aren't then they cannot be proven to be owned by his neighbour.

If they do belong to the Estate (tagged) let them know they are doing damage on your land owners property and that you will cull them and return the carcass to them at a fee.

Thanks for all the replies lads, these deer are not farmed or tagged or enclosed. The neighbouring estate just culls them for sale in their farm shop, they are free to roam over the other neighbouring estate and all the local farms. I have printed page 1 of the deer initiative about legislation and will take it with me when I go to try and persuade him to give me the permission. I wa just out foraging in the hedgerows for damsons and medlars and thought I'd have a go and knocked on his door, wish me luck :grin:

If they ain't tagged then they are wild animals on your farmer's land. Nothing to do with his neighbours if you shoot them.

All wild deer are 'res nullius' and have no owner.

Deer that are kept in a deer park have an owner and are therefore not res nullius. We had a complaint from a motor cyclist who hit a deer and tried to claim from the Estate owner but was told in no uncertain terms that he didn't have a case. If the deer was wearing an ear tag that could be traced to an owner that would have been a different matter.

Wild deer are the property of a landowner and shooting them takes them into ownership.
